Terms of Service

These terms govern use of KeepSpec, operated by KeepSpec, LLC (“we”). By creating an account you agree to them on behalf of the organization you represent, and confirm you are authorised to do so.
Ownership and publishing
The KeepSpec service is operated and billed by KeepSpec, LLC, an Indiana limited liability company. The KeepSpec mobile applications are published on the Apple App Store and Google Play by Tubesock, Inc., under a licensing arrangement with KeepSpec, LLC. Tubesock, Inc. is a registered Indiana assumed business name (d/b/a) of Rob Nolley, Inc., an Indiana corporation; you may therefore see “Rob Nolley, Inc.” listed as the seller on the App Store until Apple’s seller display reflects the Tubesock name. KeepSpec, LLC and Rob Nolley, Inc. share common ownership. Your commercial relationship — including your subscription, billing, and support — is with KeepSpec, LLC.
What the service is
KeepSpec records fluid maintenance checks and their results against specification ranges you define, and notifies you when a reading falls outside them. It keeps that history so it can be reviewed later.
What the service is not
KeepSpec records measurements. It does not take them, verify them, or judge whether a fluid is fit for use. Readings are entered or supplied by instruments you choose and maintain, and specification ranges are set by you. A reading shown as within range means only that a number someone recorded fell between two numbers someone configured.
It is not a substitute for your own testing regime, your fluid supplier’s guidance, your safety obligations, or any regulatory requirement that applies to you. Decisions about fluid condition, worker safety, machine operation and disposal remain yours. Do not rely on an alert arriving — or not arriving — as the basis for a safety decision.
Your data
You own the content you put into KeepSpec. We claim no rights over it beyond what is needed to operate the service for you. We do not sell it, do not share it with other customers, and do not use it to train anything.
You can export your data at any time while your account exists, including after a subscription lapses. See the Privacy Policy for what is stored and how deletion works.
Accounts and access
You are responsible for who you invite into your organization and what role you give them, and for the accuracy of what your people record. Tell us promptly if you believe an account has been compromised.
Subscriptions and payment
You can create an organization without providing payment details, but recording checks and other write access requires an active subscription. Starting one begins a fourteen-day trial before the first charge; cancel within it and you are not billed. Current prices are shown on our pricing page and are exclusive of any tax we are required to collect.
Subscriptions renew automatically each month until cancelled. You can cancel at any time and keep access until the end of the paid period. We do not refund part-months, but if something has gone wrong, write to us — we would rather fix it than argue about a fortnight.
If a subscription lapses, your account becomes read-only rather than closed. Existing data stays readable and exportable; new records cannot be added until billing resumes. We will not hold your history hostage over an invoice.
We may change prices with at least 60 days’ notice to account administrators. A price change takes effect at your next renewal.
Acceptable use
You agree not to use KeepSpec to:
- store personal data about individuals beyond what the service is designed for — condition notes are for the state of the fluid;
- attempt to access another organization’s data, or to probe, scan or test our systems without written permission;
- resell or provide the service to a third party as your own; or
- break the law where you or your customers operate.
Availability
We aim to keep KeepSpec available and to hold recoverable backups, but we do not offer a guaranteed uptime level unless we have agreed one with you in writing. The mobile app is designed to keep recording checks with no network connection and to sync them later, so an interruption to our service should not stop work in a plant.
Ending the agreement
You may stop using KeepSpec at any time. We may suspend or end an account that breaches these terms or that goes unpaid, and we will give reasonable notice and an opportunity to export data first, except where the law or a serious security concern prevents it.
Liability
To the extent the law allows, our total liability arising out of or related to KeepSpec is limited to the amount you paid us in the twelve months before the claim, and we are not liable for lost profits, lost production, spoiled work, equipment damage, or indirect or consequential loss.
Nothing here excludes liability that cannot lawfully be excluded — including for death or personal injury caused by negligence, or for fraud.
The service is provided “as is”. We disclaim implied warranties of merchantability and fitness for a particular purpose to the extent permitted.
Changes to these terms
We may update these terms. If a change materially reduces your rights we will notify account administrators by email at least 30 days before it takes effect.
If you do not accept a change, you may cancel before it takes effect and we will refund any unused portion of the period you have already paid for. Continuing to use KeepSpec after the change takes effect means you accept it.
Where we have signed a separate written agreement with you, that agreement governs and can only be changed the way it says it can — not by an update to this page.
Governing law
These terms are governed by the laws of the State of Indiana, United States, and the courts of Shelby County, Indiana have exclusive jurisdiction over any dispute.
